

After the court hearing resumed after half an hour, the public prosecutor could not clear the position, to which the court observed that did he even read the documents that he supplied to the court or had just forwarded without doing so. Following this, the court told the public prosecutor to study the case and come after half an hour. It also asked the public prosecutor to clear the situation that under what section the accused was booked, to which he had no answer. It was also argued that public prosecutor should stop misleading the court or Section 166 proceedings should be initiated against him for misleading the court.

The public prosecutor, however, argued that the offence was committed under Section 307, to which the defence counsel argued that the prosecutor had no knowledge about the case and if the section was there against the accused then it should be shown to the court. It was also argued that the accused had been booked under Section 188 and 201 and these all were bailable offences and under these sections the police could not even arrest the accused. During the resumed hearing of the case, defence counsel Terminder Singh argued that Gunkaran had been falsely implicated and that he was not even present at the time of incident. It was argued that the accused was arrested in bailable offences, whereas main accused Salaria was present on the spot and no action has been taken against him by police till date The court after hearing the arguments granted bail to Gunkaran and directed him to furnish bail bonds of Rs 50,000. It further observed that dealing with court was not everyone's cup of tea and the public prosecutor should be well versed with the case that he was going to argue in court. Giving a dressing down to Chandigarh police and public prosecutor, the court of civil judge Barjinder Pal observed and asked the public prosecutor whether he appeared in court without reading the documents and simply forwarded these as he failed to answer a query put up by the court.
